Building Science Development Group LLC ("Building Science Development", 'BSD Group", "BSD", "HAUS by BSD", "HAUS", “BSD Haus,” “we,” “our,” “us”) provides the Site and all related services subject to the terms below. By visiting or purchasing from the Site, you (“you,” “customer”) agree to these Terms of Service (“Terms”). Please read carefully.
1. Eligibility & Account Security
You must be at least 18 years old or the age of majority in your jurisdiction to place orders. You are responsible for safeguarding login credentials and for all activities under your account.
2. Product Information & Pricing
We strive for accuracy, but color, texture, and tonality of tiles can vary by batch and by individual screen settings. Prices, promotions, and stock availability may change without notice. In the event of a pricing error, we may cancel or adjust an order after notifying you.
3. Orders & Payment
An order becomes binding when we issue an email confirmation. We reserve the right to refuse or cancel any order (e.g., suspected fraud, shipping restrictions). Payments are processed through secure third-party gateways; we do not store complete payment card details.
4. Shipping, Returns & Refunds
Shipping and refund practices are governed by our Shipping Policy and Refund Policy, which form part of these Terms.
5. Intellectual Property
All content on the Site—including images, text, logos, and graphics—is the property of BSD Haus or its suppliers and is protected by U.S. and international copyright, trademark, and design laws. You may view, download, and print portions for personal, non-commercial use only.
6. Limited Warranties & Disclaimers
Tiles are sold “as is” except where explicit manufacturer warranties apply. We disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Sample pieces are representative, not an exact match guarantee.
7. Limitation of Liability
To the fullest extent permitted by law, BSD Haus will not be liable for indirect, incidental, special, or consequential damages, including lost profits or business interruption, arising from use of the Site or products—even if advised of the possibility. Our total aggregate liability is limited to the greater of (a) $100 or (b) the amount you paid for the product giving rise to the claim.
8. Indemnification
You agree to defend, indemnify, and hold BSD Haus and its officers, directors, and employees harmless from any claim or demand arising out of your breach of these Terms or misuse of the Site.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.
10. Changes to Terms
We may update these Terms at any time. Updated versions will be posted on this page with a revised “Effective” date. Continued use of the Site after changes constitutes acceptance.
